KİŞİSEL VERİLERİN KORUNMASI KANUNU KAPSAMINDA

ETKİNLİKLERE YÖNELİK AYDINLATMA METNİ


İSTON İstanbul Beton Elemanları ve Hazır Beton Fabrikaları Sanayi ve Ticaret A.Ş. olarak, etkinlik ziyaretçilerine ait kişisel verilerin 6698 sayılı Kişisel Verilerin Korunması Kanunu ve ikincil düzenlemelerine (“KVK mevzuatı”) uygun olarak işlenmesi ve korunması için azami hassasiyeti göstermekteyiz.

İşbu Etkinliklere Yönelik Aydınlatma Metni (“Aydınlatma Metni”), Şirketimizin sizlere yönelik olarak gerçekleştirdiği kişisel veri işleme faaliyetleri kapsamında, veri sorumlusu sıfatıyla KVK mevzuatından kaynaklanan aydınlatma yükümlülüğünün yerine getirilmesi amacıyla hazırlanmıştır.

    Çekilen tanıtım amaçlı fotoğraf ve videoların Şirketimizin ve İstanbul Büyükşehir Belediyesi’nin internet sitelerinde ve  sosyal medya hesaplarında yayımlanması, reklam kampanyaları kapsamında ve sosyal medya  hesaplarına içerik sağlanması amacıyla çekimlerin gerçekleştirilmesi

  2. Kişisel Verilerin Aktarımı

    3. Yukarıda anılan kişisel verilerinizin aşağıda anılan amaçlar ve hukuka uygunluk sebepleri uyarınca Şirket tanıtım faaliyetlerinin internet sitesi ve sosyal medya hesapları üzerinden gerçekleştirilmesi nedeniyle açık rızanız kapsamında İstanbul Büyükşehir Belediyesi’ne; yasal yükümlülüklerin yerine getirilmesi amacıyla Yetkili Kamu Kurum ve Kuruluşları’na aktarılabilmektedir. Şirketimiz yukarıda sayılan kişisel verilerinizi yurt dışına aktarmamaktadır

  3. Kişisel Verilerinizin Korunması, Muhafazası ve İmhası 

    4. Kişisel verileriniz, Şirketimiz tarafından kişisel verilerin işlenme amacının gerektirdiği süre boyunca ve azami etkinlikten itibaren 2 yıl süre ile işlenir ve her hâlükârda yasal sürenin sonuna kadar muhafaza edilir. Saklama süresinin sona ermesinin ardından kişisel verileriniz Şirketimizin Kişisel Verilerin Korunması ve Gizliliği Politikası, Özel Nitelikli Kişisel Verilerin Korunması ve Gizliliği Politikası ile Kişisel Veri Saklama ve İmha Politikası doğrultusunda KVK mevzuatına uygun olarak elektronik ve fiziki ortamlardan silinir, yok edilir veya anonim hale getirilir.     

    Kişisel verilerinize, yetkisiz kişiler tarafından erişilmesini, kişisel verilerinizin hatalı işlenmesini, ifşa edilmesini, hukuka uygun olmayan sebeplerle değiştirilmesini/silinmesini önlemek, korunmasını ve güvenliğini sağlamak amacıyla Şirketimiz KVK mevzuatı uyarınca gerekli tüm teknik ve idari tedbirleri alır. 

    Şirketimiz fiziki arşivine ve/veya sunucularına ve/veya diğer sistemlerine yapılan saldırılar sonucunda kişisel verilerinizin zarar görmesi ve/veya üçüncü kişiler tarafından ele geçirilmesi/ifşası durumunda, Şirketimiz sizleri ve Kişisel Verileri Koruma Kurulu’nu derhal bilgilendirir.

  4. KVKK Kapsamında Haklarınız

    5. KVKK’nın 11. maddesi kapsamında, Şirketimize başvurarak kişisel verilerinizin; (a) işlenip işlenmediğini öğrenme; (b) işlenmişse buna ilişkin bilgi talep etme; (c) işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme; (ç) yurt içinde veya yurt dışında aktarıldığı 3. kişileri bilme; (d) eksik veya yanlış işlenmişse düzeltilmesini isteme; (e) 6698 sayılı Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde silinmesini veya yok edilmesini isteme; (f) (d) ve (e) maddeleri uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme; (g) münhasıran otomatik sistemler ile analiz edilmesi nedeniyle aleyhe bir sonucun ortaya çıkmasına itiraz etme ve (ğ) kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme haklarına sahipsiniz.

    Bu haklarınıza ilişkin taleplerinizi, kimliğinizi doğrulayıcı belgelerle birlikte, yazılı olarak aşağıdaki adrese iletebilir ya da güvenli elektronik imza ile tarafımıza iletebilirsiniz:

  5. Taleplerinizin Değerlendirilmesi 

    6. İşbu Aydınlatma Metni kapsamında kişisel verilerinizin işlenmesine ilişkin herhangi bir sorunuz ya da talebinizin olması halinde yazılı olarak aşağıda yer alan Veri Sorumlusu bilgilerine başvurabilirsiniz. 

    Şirketimiz, KVKK’nın 13. maddesine uygun olarak, başvuru taleplerini, talebin niteliğine göre ve en geç 30 (otuz) gün içinde sonuçlandıracaktır. İşlemin maliyet gerektirmesi halinde, KVK Kurulu tarafından belirlenen tarife uygulanacaktır. Talebinizin reddedilmesi halinde, ret nedeni/nedenleri cevabı yazımızda belirtilecektir. Şirketimiz tarafından işlenen kişisel verilerinizin güncel olmadığını, eksik veya hatalı olduğunu düşünüyorsanız ilgili kişisel verinize/verilerinize ilişkin değişiklik bildirimleriniz için lütfen derhal istonbeton@hs01.kep.tr veya kvkk@iston.istanbul adresinden Şirketimiz ile irtibata geçiniz.

PRIVACY NOTICE
Issued under the Turkish Personal Data Protection Law (KVKK No. 6698)

İSTON İstanbul Beton Elemanları ve Hazır Beton Fabrikaları Sanayi ve Ticaret A.Ş. (“the Company”) is committed to processing and protecting the personal data of event visitors in full compliance with Law No. 6698 on the Protection of Personal Data. 

If you are a citizen or resident of a European Union (EU) or European Economic Area (EEA) member state, the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”) may apply to the processing of your personal data in addition to KVKK.

  2. Transfers of Personal Data

    3. Your personal data described above may be transferred to Istanbul Metropolitan Municipality on the basis of your explicit consent, for the purpose of carrying out the Company's promotional activities on its website and social media channels. Your data may also be disclosed to competent public authorities and institutions where required by applicable law. 

    The Company states it does not transfer personal data abroad. However, if you are an EU/EEA resident and your data is processed by a Turkish entity, you should note that Turkey is not currently recognised by the European Commission as providing an adequate level of data protection under Article 45 GDPR. If any cross-border transfer were to occur in the future, the Company would be required to rely on appropriate safeguards under Article 46 GDPR or one of the derogations in Article 49 GDPR. 

  3. Retention, Security, and Deletion of Personal Data

    4. Under the GDPR, personal data must not be kept in a form that permits identification of data subjects for longer than is necessary storage limitation. Your personal data will be processed by the Company for as long as required by the purpose of processing, and in any event for a maximum period of two (2) years from the date of the event. It will be retained until the end of any applicable statutory limitation period.

    Upon expiry of the retention period, your personal data will be deleted, destroyed, or anonymised from all electronic and physical media in accordance with all in compliance with KVKK.

    The Company takes all necessary technical and administrative measures under KVKK to prevent unauthorised access, unlawful processing, disclosure, or alteration/deletion of your personal data, and to ensure its protection and security.

    In the event of a cyberattack on the Company's physical archives, servers, or other systems that results in the damage, acquisition, or disclosure of your personal data by third parties, the Company will immediately notify you and the Personal Data Protection Authority.

  4. Your Rights under KVKK

    5. Pursuant to Article 11 of Law No. 6698, you have the following rights with respect to your personal data by applying to the Company:

    • to learn whether your personal data is being processed;
    • to request information if your data has been processed;
    • to learn the purpose of processing and whether it is being used in accordance with that purpose;
    • to know the third parties to whom your data has been transferred, whether domestically or abroad;
    • to request rectification of incomplete or inaccurate data;
    • to request erasure or destruction of your data within the framework of the conditions set out in Article 7 of Law No. 6698;
    • to request that the operations carried out under the two preceding items be notified to third parties to whom your data has been transferred;
    • to object to outcomes that arise to your detriment as a result of processing exclusively by automated systems; and
    • to claim compensation for any damage suffered as a result of unlawful processing of your data.

    You may submit requests relating to these rights, together with documents verifying your identity, in writing to the address below, or by means of a secure electronic signature.

  5. How to Submit a Request

    6. For any questions or requests regarding the processing of your personal data under this Notice, you may contact the Data Controller in writing using the details below. The Company will finalise your request within a maximum of 30 (thirty) days in accordance with KVKK. Where the process entails a cost, the tariff established by the Personal Data Protection Board will apply. If your request is rejected, the reason(s) for rejection will be stated in the response.
